These Terms of Service ("Terms") govern your access to and use of the website, storefront, and services (collectively, the "Site" or "Services") operated by Optides Athletics ("Optides Athletics," "we," "us," or "our"), and any purchase you make from us. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Return & Refund Policy, and Shipping Policy, each incorporated here by reference. If you do not agree, please do not use the Site or place an order.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By using the Site you represent that you are of legal age and that the information you provide is accurate, current, and complete. If you use the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Accounts
You may need to create an account to place orders or access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are involved in fraudulent or unlawful activity.

3. Products and Made-to-Order Nature
Our apparel and related goods are printed and produced on demand — each item is manufactured specifically for your order after you purchase it. Product images, colors, and mockups are for illustration; actual colors, print placement, and finish may vary slightly due to your screen settings, garment batches, and the print process. Minor variations are normal and are not defects. We do not guarantee that any particular product will remain available, and we may add, modify, discontinue, or limit products at any time.

4. Pricing, Currency, and Errors
All prices are listed in the currency shown at checkout and are subject to change without notice. We strive for accuracy, but the Site may occasionally contain errors in pricing, descriptions, availability, or images. We reserve the right to correct any errors and to cancel any order placed based on inaccurate information, even after an order has been submitted or payment received. In such cases we will notify you and issue a full refund for the affected item.

5. Orders and Acceptance
Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and we may refuse, cancel, or limit any order for any lawful reason, including suspected fraud, resale, ordering errors, or unavailability. An order confirmation email acknowledges receipt of your order but does not constitute acceptance; acceptance occurs when the item enters production or ships. Because items are made to order, changes and cancellations are only possible before production begins, as described in our Return & Refund Policy.

6. Payment
We accept the payment methods shown at checkout, processed by third-party payment providers (including Shopify Payments and their partners). By submitting payment information, you represent that you are authorized to use the payment method and you authorize us and our processors to charge the full order amount, including taxes and shipping. We do not store full payment card details; payments are handled by our processors under their own terms and security standards.

7. Taxes
You are responsible for any applicable sales, use, VAT, customs, duties, or other taxes and import fees associated with your order. Where required, applicable taxes are calculated and displayed at checkout. International orders may be subject to import duties and taxes levied by the destination country, which are the customer's responsibility.

8. Shipping and Delivery
Orders are fulfilled and shipped through our production and fulfillment partner. Production and delivery timeframes provided on the Site are estimates, not guarantees, and begin after production is complete. Risk of loss passes to you upon delivery to the carrier. We are not responsible for carrier delays, or for orders lost or returned due to an incorrect or incomplete shipping address provided by you. See our Shipping Policy for details.

9. Returns and Refunds
Because our products are made to order, all sales are final except for items that arrive damaged, defective, misprinted, or incorrect, as set out in our Return & Refund Policy. Please review that policy and the size guide on each product page before ordering.

10. Intellectual Property
All content on the Site — including designs, artwork, graphics, logos, slogans, product names, text, images, and the "Optides" and "Optides Athletics" names and marks — is owned by or licensed to Optides Athletics and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, resell, modify, create derivative works from, publicly display, or commercially exploit any of our content, designs, or marks without our prior written permission. Purchasing a product grants you ownership of the physical item only, not any rights in the underlying designs or intellectual property.

11. Trademarks
"Optides," "Optides Athletics," and associated logos, taglines, and collection names are trademarks of Optides Athletics. All other trademarks, product names, and logos appearing on the Site are the property of their respective owners and are used for identification purposes only; their use does not imply endorsement.

12. User Content and Submissions
If you submit reviews, comments, photos, or other content ("User Content"), you grant Optides Athletics a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, and display that content in connection with our business and marketing, in any media. You represent that you own or have the rights to the User Content and that it does not infringe any third party's rights or violate any law. We may remove any User Content at our discretion and are not responsible for User Content posted by others.

13. Acceptable Use
You agree not to: use the Site for any unlawful or fraudulent purpose; infringe our or others' intellectual property; upload viruses or malicious code; attempt to gain unauthorized access to the Site, accounts, or systems; scrape, data-mine, or use bots to access the Site; resell products without authorization; harass, abuse, or harm others; or interfere with the security or proper functioning of the Site. We may investigate and take legal action against violations.

14. Third-Party Services and Links
The Site relies on and may link to third-party services and websites, including payment processors, fulfillment and print-on-demand partners, shipping carriers, and social platforms. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies. Third-party links do not imply our endorsement.

15. Disclaimer of Warranties
The Site and all products and services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any product will meet your expectations. Our apparel is lifestyle and mindset apparel; nothing on the Site, on our products, or in our marketing constitutes medical, health, nutritional, or professional advice, or any claim to treat, diagnose, cure, or prevent any condition.

16. Limitation of Liability
To the fullest extent permitted by law, in no event will Optides Athletics or its owners, officers, employees, agents, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of the Site or any product, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site or a product will not exceed the amount you actually paid to us for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnification
You agree to defend, indemnify, and hold harmless Optides Athletics and its owners, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, your User Content, or your violation of any law or third-party right.

18. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Lee County, Florida, and you consent to their personal jurisdiction. Any dispute shall be resolved on an individual basis, and you waive any right to participate in a class, collective, or representative action to the extent permitted by law. Nothing here prevents either party from seeking injunctive relief for infringement or misuse of intellectual property.

19. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site with a new effective date. Changes are effective when posted. Your continued use of the Site or placement of an order after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

20. Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, for any conduct that we reasonably believe violates these Terms or is harmful to us, other users, or third parties. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

21. Miscellaneous
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Optides Athletics regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our consent; we may assign them freely. Headings are for convenience only.
